Doniger / Burroughs Prevails in Court on Behalf of Shahs of Sunset Star in Trademark Dispute

Los Angeles, CA – Diamond Water LLC and its owner, Asa Soltan Rahmati, prevailed in Court on Friday in the first round of a hotly-contested trademark infringement case. Asa and her company were being sued for trademark infringement over the use of the name “Diamond Water.” Represented by Doniger / Burroughs partner Stephen Doniger and associate Annie Aboulian, Asa and her company fought back against an attempt by Gastroceuticals, LLC to restrain and enjoin them from using the “Diamond Water” name. Gastroceuticals was attempting, among other things, to stop the airing of episodes of Shahs of Sunset, a television series in which Asa stars, from airing on the Bravo network in January.

At the hearing on January 3, 2014, the Court heard arguments from both sides and ruled in favor of the Doniger / Burroughs clients. In its order, the Court denied the motion for a restraining order and injunction, finding Doniger / Burroughs’s arguments persuasive, and ruling that Gastroceuticals, LLC was not likely to prevail on its claims. Per this order, the Shahs of Sunset episodes may air as planned, and Asa Soltan Rahmati and her company are not to be restricted in their use of the “Diamond Water” name.
