Doniger / Burroughs Obtains Discovery Sanctions in Lace Design Dispute

Venice, CA – Doniger / Burroughs client Klauber Bros., one of the world’s oldest lace design companies, is locked in a copyright dispute with an intimate apparel company and two retailers. International Intimates obtained from Klauber Bros. a number of samples of Klauber Bros.’ proprietary lace designs. Instead of then buying the lace with these designs from Klauber Bros., International Intimates covertly created at an overseas mill a number of different garments that look to bear near-verbatim copies of Klauber Bros.’ proprietary lace designs. Perhaps because of the clear evidence of infringement facing International Intimates, the company engaged in obfuscatory tactics during the evidentiary exchange portion of the pending cases. Doniger / Burroughs filed a motion with the Court to address this misconduct and seek sanctions. On February 18, 2015, the Court granted this request, ordering International Intimates to produce further evidence of the conduct at issue, and to pay to Doniger / Burroughs monetary sanctions.
