Doniger / Burroughs Client Hale Bob Defeats Motion to Dismiss filed by Macys [Fashion] [Copyright]
Los Angeles, CA – French West, Inc., which does business as “Hale Bob,” is a well-known clothing designer whose wares you may have seen on billboards around Los Angeles. Macys misappropriated the look and feel of one of Hale Bob’s signature pieces to capitalize on Hale Bob’s creativity and design and “create” its own branded garment.
Doniger / Burroughs brought a copyright infringement lawsuit on behalf of Hale Bob. In an attempt to evade liability for the unlawful copying, Macys filed a motion to dismiss the case. The Honorable George H. King reviewed and considered Macys’ motion, and the opposition filed by Doniger / Burroughs partner Scott A. Burroughs, and ruled in favor of Hale Bob. The case will now proceed toward trial.
