Doniger / Burroughs Wins Motion to Dismiss Claims Against Filmmaker

Venice, CA – Sharp Electronics obtained an image of artist Mad Steez and one of his iconic paintings and used that image to market and sell its flat screen televisions. When Sharp Electronics was sued for this unlawful use, it claimed that it obtained the image from a film submitted in connection with a contest held by Sharp. In making this claim, it filed a lawsuit against the filmmaker that submitted the project, claiming breach of contract, among other things. On December 17, 2015, the Court granted Doniger / Burroughs’s motion to dismiss these claims.

Doniger / Burroughs Prevails on Summary Judgment in Fashion Industry Dispute

Venice, CA – Premier Fabrics, a fabric design studio with offices in Los Angeles and New York, brought suit against two companies that had copied one of Premier’s proprietary textile designs and sold garments bearing the unauthorized copies. The defendants denied infringement, and the case progressed to the summary judgment stage. In a ruling issued on December 21, 2015, the Court granted Premier’s motion for summary judgment and found that the defendants had committed copyright infringement through their unauthorized exploitation of Premier’s proprietary copyrighted work. The case will now proceed to trial on ancillary issues and damages.

Doniger / Burroughs Takes to Task AP, NBC, Huffington Post, LA Times, Al Jazeera, and Others for Copyright Infringement and DMCA Violations

Venice, CA – Doniger / Burroughs has brought a copyright infringement and DMCA action on behalf of photographer Kevin Pack (Silvertip Partners) against various media outlets for  the unauthorized use of his photographs and the removal of his copyright attribution information.

Mr. Pack, a former firefighter who works closely with Cal-Fire to photograph wildfires, allows his photographs to be used by news outlets  in connection with reporting on the fires photographed provided his copyright management information is retained. When he found his images being commercialized, used with altered or removed copyright information, and used in connection with unrelated fires, he took action.
