DONIGER / BURROUGHS SECURES NAME RIGHTS FOR TOM BINNS

Venice, CA – Doniger / Burroughs has successfully transitioned veteran jewelry designer Tom Binns out of a disputed partnership. Mr. Binns has a sparkling reputation for jewelry design, having been featured in dozens of international publications and shows over the past 30 years, including Italian Vogue, the New Yorker, French Vogue, the London Observer, Women’s Wear Daily, Japanese Vogue, Italian Elle, the Financial Times, Image Magazine, Donna Italia, The New York Times, and Stern.

When a company he started in 2007 went south and the minority owner of the company claimed trademark rights in “Tom Binns,” Stephen Doniger and Frank Gregory Casella of Doniger / Burroughs designed an elegant solution for Mr. Binns to retain all rights in his name and work. Unchained from that company, Mr. Binns can now return to creating great art.

Doniger / Burroughs Prevails at the 9th Circuit Court of Appeals in Jewelry Design Dispute

Pasadena, CA – The 9th Circuit Court of Appeals ruled today in a long-simmering copyright infringement case arising out of the alleged copying of jewelry designs created and owned by a Doniger / Burroughs client. The district court had ruled in favor of the alleged infringer, finding that the jewelry pieces were not legally similar. The 9th Circuit, though, granted the appeal filed by Doniger / Burroughs, finding that the district court’s ruling was erroneous, reversing its decision, and remanding the case for trial.

Scott Alan Burroughs, Esq. of Doniger / Burroughs argued for appellant.
Robert Helfing, Esq. of Sedgwick LLP argued for appellee.
