Los Angeles, CA – Clients often ask what happens when a defendant is uncooperative in discovery. If your counsel is Doniger / Burroughs, the result could be sanctions of over $13,000.00 plus a court order that effectively precludes the offering of a defense. Such was the case recently when a defendant refused to produce a proper witness and certain evidence. The Magistrate Judge overseeing discovery in the case styled Minx Int’l. v. Pacific Eurotex, Case No. 2:13-cv-5950 saw through the flimsy defenses offered by defense counsel and ordered payment of over $13,000.00 in sanctions while also excluding one of the defendant’s key trial witnesses.
Partner Stephen M. Doniger, who secured the ruling, commented: “This should serve as a deterrent to copyright infringers who think they can play hide-the-ball until the eve of trial.”
Editor’s note: The case settled after the discovery order on favorable terms.
