Los Angeles, CA – Doniger / Burroughs partner Stephen M. Doniger published the article, “Fees in Copyright Arrest its Purpose,” in the Daily Journal on August 21, 2015. The article analyzes the legislative intent of the Copyright Act’s fee-shifting provision, which was promulgated to encourage more creative expression by allowing a victor in a copyright infringement action to recover its (often substantial) attorneys’ fees. Unfortunately, that purpose has been frustrated by the limitation on the ability of Plaintiffs to recover attorneys’ fees without timely registration while being potentially liable to Defendants for their fees.
